General conditions of sale

GENERAL PROVISIONS

These conditions are only valid between the company Calz. Peron s.r.l., with registered office at Via Premaore 57, 30010 Camponogara (VE), Italy, VAT number 00330560277 (hereinafter referred to as “Peron”), and any person who makes purchases online on the website www.viadellapaglia.com (hereinafter referred to as the “Customer”). These conditions may be subject to change: their date of publication on the website is considered as their date of entry into force.

These conditions govern purchases made on the website www.viadellapaglia.com, in accordance with the provisions of Part III, Title III, Chapter I of the Italian Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014, and by Legislative Decree 70/2003 on electronic commerce.

SCOPE OF THE CONTRACT

With these general conditions of sale, Peron sells, and the Customer remotely purchases, the tangible movable goods indicated and offered for sale on the website www.viadellapaglia.com. The contract is concluded exclusively through the internet via access by the Customer to the website www.viadellapaglia.com, and the creation of a purchase order according to the procedure provided for by the site itself.

Customers agree to read these general conditions of sale, namely the pre-contractual information provided by Peron, before confirming their order, and to accept them by placing a flag in the indicated box.

In the order confirmation e-mail, the Customer will also receive a link to download and archive a copy of these general conditions of sale, as required by Art. 51(1) of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

PRE-CONTRACTUAL INFORMATION FOR CONSUMERS – ART. 49 of Legislative Decree 206/2005

Before the conclusion of the purchase contract, Customers examine the characteristics of the goods that are illustrated in the individual product sheets when making their selection.

Before validating the order with “obligation to purchase”, the Customer is informed as regards:

• the total price of the goods, including taxes, with details of shipping and any other costs;
• payment methods;
• the time frame within which Peron agrees to deliver the goods;
• conditions, terms and procedures for exercising the right of withdrawal;
• the fact that the Customer shall bear the cost of returning the goods in the event of withdrawal;
• existence of the legal guarantee of conformity for the goods purchased.

SHIPPING COSTS

Shipping via DHL:

• Free for Italy and Europe* / standard shipping of 4-6 working days from the day after the order;
• € 10.00 for Italy and Europe* / Express shipping of 2-3 working days from the day after the order;
• € 20.00 for non-EU countries / customs fees will be borne by the customer.

It is possible to check the progress of a shipment by using the tracking number provided upon shipment of the goods, by entering the details at www.dhl.com.

* The following countries are considered as Europe: Austria – Belgium – Bulgaria – Cyprus – Croatia – Denmark – Estonia – Finland – France – Germany – Greece – Ireland – Italy – Latvia – Lithuania – Luxembourg – Malta – Netherlands – Poland – Principality of Monaco – United Kingdom (UK) – Czech Republic – Romania – San Marino – Slovakia – Slovenia – Spain – Sweden – Hungary.

Please provide an address where the courier can physically deliver the package.

If the recipient is absent at the time of delivery, the courier will attempt delivery in the following days. DHL customer service can be contacted at 199 199 345.

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The contract of sale is considered concluded with the sending of an e-mail by Peron to the Customer confirming the order. The e-mail contains the Customer data, order number, price of the goods purchased, shipping costs and the delivery address to which the goods will be sent, and the link to be able to print and archive the copy of these general conditions of sale.

The Customer agrees to verify the correctness of personal data contained in the above email, and to promptly notify Peron of any corrections/amendments to be made.

Peron agrees to describe and present the items sold on the website in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the product depicted on the site and the actual product may occur. Photographs of the products presented on www.viadellapaglia.com do not constitute a contractual element, as they are to be considered as solely representative.

Peron agrees to deliver the goods within 20 days from send date of the order confirmation email by Peron to the Customer.

PRODUCT AVAILABILITY

The availability of the products refers to actual availability at the time when the Customer places the order. This availability must be considered purely indicative, as:

• the products could be sold to other Customers before the order is confirmed if multiple users are attempting to simultaneously purchase them;
• an IT anomaly could occur such as to make a product available for purchase that in reality is not.

Partial or total unavailability of the goods may exist, even after the order confirmation email is sent by Peron. In this case, the order will be automatically rectified with the elimination of the unavailable product or products, and the Customer will be immediately informed by e-mail. This email will also inform the customer as to the methods and time frame of reimbursement of any sums paid.

PAYMENT METHODS

Payment by the Customer can only be made by means of the credit cards indicated on the website www.viadellapaglia.com, or with Paypal.

For payment by credit card, the actual amount of the order will be charged the following day.

Communications regarding payment and data provided by the Customer takes place on special, protected lines. The security of credit card payments is guaranteed through VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.

PRICES

All sales prices of the products indicated on the website www.viadellapaglia.com are in Euros and include VAT.

Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made.

The Customer accepts the right of Peron to change its prices at any time; items will be invoiced on the basis of prices indicated on the site at the time the order is created, and indicated in the confirmation email sent by Peron to the Customer.

In the event of an IT, manual, technical, or any other kind of error that could lead to a substantial change of the retail price not foreseen by Peron that renders it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled, and the amount paid by the Customer will be refunded within 14 days from the date of cancellation.

RIGHT OF WITHDRAWAL

In accordance with the legal provisions in force, the Customer has the right to withdraw from the purchase without any penalty within 28 days from the date of receipt of the order, but must specify the reason.

Return instructions

To request a return authorisation, it is necessary to fill in the request with the form available in the returns section. Once the procedure has been completed, Peron will send a confirmation by e-mail containing the Return Authorisation number (RAN), shipping label and instructions to be followed to return the goods.

Return shipments made with the courier indicated by Peron are free of charge.

If the return is sent back using a different courier, all costs will be borne by the Customer.

The Customer also has the right to return a product purchased online at the registered office of Peron. In this case, all costs related to the return will be borne by the customer (e.g. petrol, highway tolls, etc.).

The return shipment must take place within 28 days of receiving the order.

The goods must be returned to Peron s.r.l., at its registered office at VIA PREMAORE, 57 – 30010 CAMPONOGARA (VE) – ITALY.

Two types of compensation are available.

Exchange: it is only possible to exchange for a different size or different colour of the same item, if available. The new item requested can be returned following the same procedure.

Refunds: refunds will be made as soon as the returned product arrives at the Peron warehouse and the footwear has been checked.

For orders paid by credit card, the refunded amount will be available to customers in approximately 15 days and will still be visible on the subsequent card statement. The time frame may vary slightly depending on the banking circuit of the credit card used.

For orders with Paypal, the amount will be returned to the original account.

The refund will be issued in the same currency as that of the original purchase. Any differences in amount due to exchange rate fluctuations cannot be refunded. Any cost originally incurred for shipment of the order will be reimbursed to the customer only in the event that all of the items purchased are returned.

As required by Art. 56(3) of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Peron may suspend reimbursement until receipt of the goods, or until the Customer demonstrates to have returned the goods to Peron.

It is understood that if a product is defective the shipping costs will be borne by Peron.

Terms and Conditions

The security cord on returned items must not be cut or broken. Footwear must not show any signs of use. Soles of the shoes must be in perfect condition and not have marks of any kind.

Each pair of footwear must be returned with all labels and tags attached, along with its original packaging and accessories as received with the order.

All footwear and accessories must be returned together with their original box, which is considered an integral part of the product itself to all intents and purposes. The box must not have been damaged and/or altered in any way, nor used as sole external packaging.

Peron reserves the right not to accept returns shipped with couriers other than those indicated in the email with the return instructions if the delivery involves additional costs for Peron or requires collection by the courier at a branch.

Peron also reserves the right to refuse unauthorised returns or returns that do not meet all of the conditions for return. In these cases, the goods will be returned to the sender at the original shipping address. Any acceptance of such returns will be subject to a charge equal to 10% of the value of the returned goods.

European legislation on remote purchases shall apply to all aspects not specifically governed herein.

LEGAL GUARANTEE OF CONFORMITY

If defective products or products that do not comply with the orders placed are received, the Customer has the right to obtain the correct product without charge by repairing or replacing the product.

The product is certified at the time of purchase on the Blockchain.

The initials of the purchaser and order number will appear on the guarantee certificate, which is registered.

DELIVERY METHODS

Peron will only accept orders for delivery within Italy and abroad. The products will be delivered by courier to the address indicated by the Customer in the order no later than 20 days from send date of the order confirmation email by Peron to the Customer.

Peron will issue an invoice for goods shipped for every order placed on the website www.viadellapaglia.com. The invoice will be sent to the Customer via e-mail. The invoice will contain the information provided by the Customer during the purchase process. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.

LIABILITY

Peron assumes no liability for inconveniences attributable to force majeure or unforeseeable circumstances, even if such is due to malfunctions and inefficiencies of the internet, in the event of failure to execute the order within the time frame stipulated in the contract.

WEBSITE ACCESS

The Customer has the right to access the website for viewing and making purchases. No other use of the website or its content is permitted, especially as regards to commercial purposes. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of Peron and are protected by intellectual property rights.

ENTIRE AGREEMENT

These general conditions of sale are formed by all of the clauses herein. If one or more provisions of these general conditions of sale are considered invalid or declared as such pursuant to law, regulations, or following a decision by a court with jurisdiction, the other provisions will continue to have full force and remain in effect.

APPLICABLE LAW AND JURISDICTION

These General Conditions of Sale are subject to Italian law.

Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the court of the place of residence or domicile of the Customer, if located within Italy.

It is possible to optionally use the mediation procedures referred to in Legislative Decree 28/2010 for the resolution of any disputes arising in the interpretation and execution of these general conditions of sale.
